1. Eligibility & Legal Compliance

You must be at least 18 years of age to use this website. To purchase a handgun, you must be at least 21 years of age. To purchase a long gun (rifle or shotgun), you must be at least 18 years of age. These age requirements are set by federal law and are strictly enforced.

By placing an order, you represent and warrant that:

• You meet the minimum age requirement for the item(s) you are purchasing.
• You are legally permitted to purchase and possess the item(s) under federal, state, and local law.
• You are not prohibited from receiving or possessing firearms or ammunition under 18 U.S.C. § 922(g) or any applicable state law.
• All information you provide during checkout is accurate and complete.

Black Helmet Gun Shop reserves the right to refuse any order if we have reason to believe a purchase may violate applicable law.

2. FFL Transfers & Federal Law

Black Helmet Gun Shop is a federally licensed firearms dealer (FFL). All firearm sales — whether completed in our store or shipped from an online purchase — are subject to federal law, including background check requirements under the Brady Handgun Violence Prevention Act.

Online Firearm Purchases

Firearms purchased through our online store cannot be shipped directly to a buyer's home. All firearms must be transferred through a licensed FFL dealer. If you purchase a firearm online:

• You must designate a receiving FFL dealer at or before checkout.
• The firearm will be shipped to your chosen FFL dealer.
• You must complete a federal Form 4473 and pass an NICS background check before taking possession.
• Your receiving FFL dealer's transfer fee is separate from and not included in our purchase price.

In-Store Purchases

All in-store firearm purchases require completion of ATF Form 4473 and a NICS background check prior to transfer. Black Helmet Gun Shop will not complete a transfer if a background check is denied or if we have a good-faith reason to believe the transaction would be unlawful.

NFA Items

Suppressors, short-barreled rifles, short-barreled shotguns, and other NFA-regulated items are subject to additional federal requirements including ATF Form 4 approval and a $200 tax stamp. NFA transfers can take several months. Black Helmet Gun Shop is Class III licensed and handles NFA transfers — contact us before purchasing any NFA item for current wait time estimates.

3. Purchases & Pricing

All prices are displayed in U.S. dollars and are subject to change without notice. We reserve the right to correct pricing errors and to cancel orders placed at an incorrect price. You will be notified and given the option to reorder at the correct price or receive a full refund.

Payment is due in full at the time of order. We accept major credit cards and debit cards. Orders are not confirmed until payment is successfully processed.

Iowa sales tax will be applied to applicable orders in accordance with Iowa state law. Firearms accessories, ammunition, and other taxable goods will include applicable state and local tax at checkout.

We reserve the right to limit quantities on any item and to refuse service to any customer at our discretion.

4. Shipping & Delivery

We ship to all states where the ordered item is legal. It is your responsibility to verify that the item you are ordering is legal in your state, county, and municipality before placing an order. Black Helmet Gun Shop is not responsible for orders that cannot be completed due to local restrictions.

Firearms are shipped only to licensed FFL dealers. Ammunition and accessories may be shipped directly to customers where permitted by law. Certain states restrict or prohibit the direct shipment of ammunition — if your order cannot be fulfilled due to state restrictions, we will notify you and issue a full refund.

Estimated shipping times are provided at checkout and are not guaranteed. Black Helmet Gun Shop is not liable for delays caused by carriers, weather, or circumstances outside our control.

Risk of loss passes to the buyer upon delivery to the carrier. If your order arrives damaged, contact us within 48 hours of delivery.

5. Returns & Refunds

Firearms: Due to federal law, all firearm sales are final once a Form 4473 has been completed and the transfer has occurred. Firearms may be returned before transfer is completed only if the background check is delayed or denied and the transfer cannot legally proceed.

Ammunition: All ammunition sales are final. We do not accept returns on ammunition for safety reasons.

Accessories & Gear: Unused accessories and gear in original, unopened packaging may be returned within 30 days of purchase with a receipt. Items showing signs of use, installation, or modification are not eligible for return.

Defective Items: If you receive a defective item, contact us within 7 days of receipt. We will work with you and the manufacturer to resolve the issue through warranty service or replacement.

Refunds are issued to the original payment method within 5–10 business days of approval.

6. Prohibited Uses

You may not use this website or purchase our products for any unlawful purpose. Prohibited uses include, but are not limited to:

• Purchasing firearms or ammunition on behalf of someone who is prohibited from owning them (straw purchase — a federal felony).
• Providing false information on any ATF form or during the checkout process.
• Attempting to circumvent background check requirements.
• Purchasing items for resale without a valid FFL or dealer license where required.
• Using this website to scrape, harvest, or collect user data.
• Attempting to gain unauthorized access to any portion of this website or its infrastructure.

Violation of these terms may result in order cancellation, account termination, and referral to law enforcement where appropriate.

7. User Accounts

You may create an account on our website to manage orders and save your information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to notify us immediately at blackhelmetgunshop@hotmail.com if you suspect unauthorized access to your account. We are not liable for losses resulting from unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these terms or that we believe are being used for fraudulent purposes.

8. Intellectual Property

All content on this website — including text, images, logos, graphics, and code — is the property of Black Helmet Gun Shop or its content suppliers and is protected by applicable copyright and trademark law. You may not reproduce, distribute, or create derivative works from any content on this site without our express written permission.

Product images and descriptions sourced from manufacturers or distributors remain the property of their respective owners.

9. Disclaimers & Limitation of Liability

This website and its content are provided "as is" without warranty of any kind, express or implied. Black Helmet Gun Shop makes no representations or warranties regarding the accuracy, completeness, or suitability of any information on this site.

To the fullest extent permitted by law, Black Helmet Gun Shop shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this website or purchase of our products, including but not limited to loss of data, loss of profits, or personal injury.

Our total liability to you for any claim arising from a purchase shall not exceed the amount you paid for the item giving rise to the claim.

Black Helmet Gun Shop is not responsible for the safe storage, handling, or use of any firearm or ammunition after it has been legally transferred to the buyer. Firearm safety is the responsibility of the owner.

10. Governing Law

These Terms of Service are governed by the laws of the State of Iowa, without regard to conflict of law principles. Any dispute arising from these terms or from a purchase shall be brought exclusively in the state or federal courts located in Iowa County, Iowa. You consent to personal jurisdiction in those courts.

11. Changes to These Terms

We may update these Terms of Service at any time. Changes will be posted on this page with a revised effective date. Continued use of this website after changes are posted constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
